The creeks
The Corps of Engineers must be notified before work in Shoal Creek, Spring River, North Fork Spring River, Elk River, or Indian Creek (Missouri Regional Condition 5). Shoal Creek, Spring River, and Elk River hold protected mussel habitat for the Neosho mucket (2015 rule). Newton County is cave country. The Neosho National Fish Hatchery spring holds the Ozark cavefish.
In Oklahoma the Neosho (Grand) River crossing is a navigable water. In Kansas the Verdigris and Fall rivers carry the same mussel habitat.
Baynham Branch Reservoir: 828 acres, about 20 million gallons a day, eminent domain, same township as the new Newton County right-of-way. Corps file SWL-2019-00034. Ask for the demand projections.
Write the Corps Little Rock District Branson office, 417-213-4796, and Tulsa District. Ask for individual permits at those crossings. Write Missouri DNR for individual 401 certification. FOIA the Corps for the reservoir demand numbers.
