Whose land

Fee land is still fee land. Trust land is not.

Craig and Nowata counties sit inside the Cherokee Nation Reservation. Ottawa County holds recognized reservations of the Quapaw, Peoria, Miami, Ottawa, and Wyandotte nations, plus Eastern Shawnee, Seneca-Cayuga, and Modoc lands.

A line can still cross privately owned land inside a reservation. Land held in trust or restricted status needs the tribe or the owners to say yes and the Bureau of Indian Affairs to approve under 25 CFR Part 169. It cannot be condemned.

How to check a nearby tract: county assessor tax-exempt flag, BIA Miami Agency 918-715-4295, the tribe’s realty office. Ask your tribe whether AEP has asked for consent.

Historic preservation offices of the Osage, Quapaw, Cherokee, Peoria, Shawnee, Delaware, Wichita, and Kaw can ask to be consulted on every federal permit in all three states. Kansas routes near Arkansas City cross ground associated with Etzanoa, the ancestral Wichita city.
